    What does Jonathan Turley really think?

    When the Comey and James indictments were filed, many of us in the legal profession noted a couple of problems. First, the James indictment seemed disjointed after the denial of a key charge. With time running out, Acting U.S. Attorney Lindsey Halligan quickly stitched the remaining counts together and filed the indictment. It was ad hoc and hardly ideal.

    The main problem we identified was Halligan herself. The former private counsel for Trump was appointed acting U.S. attorney after the removal of her predecessor, Erik Siebert, who reportedly resigned after expressing reservations about the legal basis for the indictment.

    The problem is that a federal statute, 28 U.S.C. § 546, governs the appointment of interim U.S. attorneys when a vacancy arises. A president has 120 days to appoint such an official while awaiting a Senate-confirmed replacement. Siebert had already used that 120-day period, and the statute mandates that, after its expiration, the district court appoints the acting U.S. attorney.

    While the Justice Department has argued in good faith that the law can be more broadly interpreted, other judges have supported the plain meaning, including a New Jersey court that disqualified another former personal counsel for Trump, Alina Habba, from serving as U.S. attorney.

    Judge Currie effectively declared, "Time’s up." She also noted that the rush to indict followed the president’s social media post expressing anger over the failure to indict these individuals. The president wrote: "What about Comey, Adam ‘Shifty’ Schiff, Leticia??? They’re all guilty as hell, but nothing is going to be done."

    He later took down the post, but the damage was done.

    There are still challenges over whether these indictments constitute selective or vindictive prosecutions. The defendants are using the president’s post as Exhibit 1. If Judge Michael Nachmanoff rules that these indictments are invalid for other reasons or constitute selective or vindictive prosecution, there would be no procedural "cure" absent a reversal on appeal.



    Turley mentions that Halligan's replacement as the prosecutor would be appointed by the court (or be a Senate-confirmed nominee). In other words, the next US attorney will be a real lawyer. They are likely to follow the lead of every other lawyer in the the Eastern District of Virginia who declined to prosecute the Comey and James cases. They also wouldn't violate grand jury rules like Lindsay Hooligan.

    Of course there's a chance. But, pb's been saying all along. Trump's goal is not to put these people in the slammer but to harrass them and make them waste money on lawyers.

    I doubt Trump has given up.

    There are times that I think I understand Trump's evil more than any of you TDSers

    You just illustrated why Trump's DOJ will continue to step on rakes and lose in their efforts to convict Trump's enemies. What you describe is called vindictive prosecution, which is why the cases will be thrown out.

    Maybe you should set your TDS aside and become a disciple of pb,... as far as the OrangeTurd is concerned.

    Your comment matches what I've been saying about the sandwiching of Trump's political adversaries for whom he has particular venom. Do you know Stephen Covey's classic SEVEN HABITS OF HIGHLY EFFECTIVE PEOPLE? Habit number 2? "Begin with the end in mind."

    As far as pb can tell, this is, as you say, vindictive prosecution. Like, duh, man.

    And, yinz have nearly 3 1/2 years left... even if Dems sweep both Houses of Congress in 026, keehee ha!

    Why would I regret that the DOJ is stepping on rakes and Trump is being thwarted by his perceived enemies? Kilmar Garcia-Abrego, Comey, Letitia James, Adam Schiff and others will be using Trump's vindictive prosecution against him and his DOJ.

    The DOJ is making unpopular and ham-fisted efforts to obtain voter registration information. They are spending their time fighting contempt charges and demonstrating incompetence. It does this Democrat's heart good.

    Trump is languishing in the polls and bringing the Republican party down with him. Belatedly Republicans are turning against Trump. There are more Republicans exiting Washington than Democrats. No Democrat could have accomplished all that. What's not to like?

    This is a dysfunctional DOJ. I can think of few times when this DOJ couldn't manage to get a grand jury to indict. Multiple DOJ prosecutors have refused to vindictively prosecute Trump's perceived enemies. The Trump DOJ attorneys are frequently chastised by judges for incompetent or unethical behavior.
