More than two months after the Trump administration admitted it mistakenly deported Abrego Garcia from Maryland to his native El Salvador, a federal grand jury has indicted him for allegedly transporting undocumented migrants within the United States, ABC News has learned.

    1. Despite insisting that they could not retrieve Abrego Garcia because he was in another sovereign nation, after three months Abrego Garcia is back on US soil.
    2. He will be charged with smuggling of migrants. That doesn't sound like a case involving state secrets like Trump administration lawyers are claiming.

    Police offered to take the Maryland daddy into custody at the time and Biden's FBI didn't accept the offer.

    That part of the story will get a lot of attention beyond the progressive SwampMedia... and, especially in the New Media... which the people who voted to hand DC to the GOPs follow.

    This is definitely a bloody nose for the Trump admin. When they claimed that they said they couldn't bring Garcia back to American soil, that they "couldn't do anything about it", turns out that "doing anything about it" was "making a phone call to Bukele."

    By international law, you can't "legally" be a foreign government (country #1) and take a citizen of country #2 out of that country to stand trial without country #2's approval. So trumpster was right. If he didn't ask that government? I dunno.

    I am aware of immigration laws. Yes, by all means, you should look it up and understand it! Those accused of violating immigration laws or any other laws do not get tossed into a foreign prison for indeterminate amount of time without due process. For further reading see the 5th and 14th amendments.

    I am fine with him being indicted, charged and his having his day in court. That is what should have happened in the first place.

    So garcia comes back. BFD. Obviously, they decided to put him in federal prison. No skin off my nose. That way, asshole has had his day in criminal court. Even though immigration law is civil and the "due process" laws are different. So he spends 2-10 years in our prison, he gets out and is sent immediately to el Salvadore. No one can say anything. Trumpster went the extra mile to take care of some asshole that markets in human trafficking. And to boot, my bet is that he'll go the Salvadorian supermax prison he wasn't in before. And then the other gang will shank him and he'll die. That is, if he lasts in US prison and a rival gang doesn't get him there. It was a political ploy trumpster lost on. Oh well🙄.

    And it absolutely does not surprise me the libs are still in favor of human trafficking. It goes back to the southern dims during the civil war. Their belief in human bondage is well known and taught in schools in the US. And even here, the libs voice their support of human trafficking. And get away with it.

    First off, today is the first we heard about Abrego Garcia being accused of human smuggling. It sounds like Trump & co. spent about three months trying to come up with a crime to charge him with...even if the Trump DOJ had to fabricate it.

    If they did know in advance, why didn't they charge him and try him? Instead he was sent to El Salvador where, being in a sovereign nation outside of US control, he could have been immediately released.

    Here is my prediction: the witnesses against Abrego Garcia are unreliable and likely coerced by Trump officials.

    All we wanted was real due process for Garcia. If he's convicted and there's no monkey business going on with any witnesses, we'll be fine with him serving a prison sentence.

    Also, now that we know that Trump really can "facilitate" a deported prisoners release and return, there were 140 other guys with him sent to the El Salvador prison without a trial. The courts will not allow Trump to keep them in a Latin American gulag.

    True statement. Like I said above that I guess you didn't read. You have to negotiate the release. If you haven't seen the numerous cases of (mostly) murderers that are living in Mexico, and other countries that won't release the murderers unless the death penalty is off the table.

    SCOTUS already ruled on this (Jun 16 2024[3] and Apr 08, 2025[4]. The SCOTUS DECISION was 1. a rebuke (and scolding) of the lower court, and 2. the administration must take steps IN THE FUTURE to ensure immigration law is fulfilled. We already went through this ad nauseum. I said this all before. I provided the immigration law for you (which isn't under section 18. Meaning it's a CIVIL matter and different rules apply. I agreed with SCOTUS at the time, and I still do. The administration needs to "fix" the system they had. That includes immigration judges. There is no jury, no "trial" unless the immigrant chooses to hire one. The rules are actually far simpler than section 18 law (which includes human trafficking BTW).[2]

    So grow up. You lost the first case. You need to look at future cases, which apparently is going according to the SCOTUS rules. How do we know that? Because people are being deported still, with the watchdogs not saying a word. Knowing that, I am okay with what the administration is doing. According to IMMIGRATION LAW, they are getting due process. End of Story.

    I wouldn't call DHS a "news source". But even according to that he was only "suspected" of human smuggling but barely so, that because he was driving in TN with eight passengers. No action was taken. No charges.

    The encountering officer decided not to cite the subject for driving infractions but gave him a warning citation for driving with an expired driver's license. Abrego Garcia’s driver's license was a MD "Limited Term Temporary” license. The encountering officer gathered names of other occupants in the vehicle but could not read their handwriting. The officer did not pursue further information due to no citation being issued.

    In 2019, the Prince Georges County Police Gang Unit validated Abrego Garcia as a member of the Mara Salvatrucha (MS-13) Gang.


    Btw, notice that 2019, while Trump was president, it was " validated" that Abrego Garcia was an MS-13 gang member.

    El Salvador's president Bukele(sp?) said if Trump asked, "of course I'd return him". It is not an extradition issue.

    I am sure Trump will be pressured by the courts to retrieve the other guys sent to CECOT.

IF you're referencing the lower court's decision in this case, pre-SCOTUS ruling. THIS is the judge who got chastised by SCOTUS for 1. overreach*, 2. a bad legal decision. IF there is ANY decision brought up from now on, there is already judicial precedence set by SCOTUS in this case. Therefore, the courts MUST, BY LAW follow the HIGHER COURT'S (SCOTUS) ruling.

    You're trying to wiggle out of this one, and it's not working. The FACTS don't support you, regardless of your "feelings."


    *He's a district judge that was ruling for the entire country. He can't do that. It's not how the system works. Anyone outside his district doesn't have to follow his decision. He took it upon himself to rule for the entire nation. SCOTUS slapped his hand pretty hard for not knowing the way our system works.

    I'm still having trouble with why you've supported this known wife-beater, who's also illegally entered the US (twice), and has already been deported once. Immigration law is very clear of this. There is a legal paper trail of these acts. He can (and should be) deported. According to the law, he's a three striker and doesn't need the criminal charges to be deported. Now, because of his lawyers (they make a lot more money going to trial, win or lose), you have your wish. A criminal trial in which he (alone) will be deported. His wife and kids are left here to fend for themselves. In the Criminal system, the state has no authority to move the family. So be careful what you wish for.

    And, bubba, because I monitor right-wing media regularly, I have seen the BODY CAM recordings of the traffic stop. (And, BTW, the future Pope Kilmar has quite a gut on him.)

    As I have noted to po frequently, we're at the indictment stage. As I told po with all the Trump lawfare stuff, an indictment is not the text of a unanimous Supreme Court decision.

    Don't even begin to think that this indictment... and claims made by the AG... is even evidence presented to a jury. What we're seeing now is, absolutely, nothing more than grandstanding.

    But, juries love video evidence. Based on the body cam, Kilmar is toast. Burnt toast.

    About my prediction that the case against Abrego Garcia would hinge on unreliable testimony, call it lucky or educated guess.

    Abrego Garcia's lawyer, Simon Sandoval-Moshenberg, called the criminal charges "fantastical" and a "kitchen sink" of allegations.
    "This is all based on the statements of individuals who are currently either facing prosecution or in federal prison," he said. "I want to know what they offered those people."
    The indictment also led to a high-level resignation in the federal prosecutor's office in Nashville, with news that Ben Schrader, chief of the criminal division for the Middle District of Tennessee, had resigned in protest.
    A 15-year veteran of the U.S. Attorney's Office, Schrader had grown increasingly uncomfortable with the administration's actions, and the indictment of Abrego Garcia was "the final straw," a person familiar with the situation told Reuters. Schrader declined comment.



    If Abrego Garcia is charged with wife beating or any other crime, fine. But he should have his day in court.

    Don't blame the prognosticator! I merely predicted the case against Abrego Garcia would be built upon testimony of unreliable witnesses. It is not my fault early reports say that the Trump DOJ is relying on prisoners hoping to make a deal. Wait until at least the discovery process when the prosecution is required to reveal their witnesses.
