The Supreme Court unanimously revived a straight woman's "reverse discrimination" case against her former employer Thursday, lowering the legal hurdle for white and straight employees to bring such lawsuits.

The 9-0 decision rejects that members of a majority group must show "background circumstances" in addition to the normal requirements to prove a claim under Title VII of the Civil Rights Act of 1964, which prohibits employment discrimination based on race, color, religion, sex and national origin.

Marlean Ames, who worked for the Ohio Department of Youth Services for two decades, sued under the landmark law over claims she was passed over for a promotion and demoted in favor of gay colleagues.

In 2019, she interviewed for another job at the department but was not hired. Her gay supervisor suggested she retire, and days later, Ames was demoted with a significant pay cut. A 25-year-old gay man was then promoted to become PREA administrator. And months later, the department chose a gay woman for the role Ames unsuccessfully applied for.

Ames' appeal at the Supreme Court was supported by the Justice Department, the American First Legal Foundation and the libertarian Pacific Legal Foundation, among others. The NAACP Legal Defense & Educational Fund and the National Association of Counties were among those that filed briefs backing Ohio.

    She has a ways to go...

    The U.S. Court of Appeals for the Sixth Circuit, in Cincinnati, said she could have satisfied the “background circumstances” requirement by showing that decisions about her employment were made by “a member of the relevant minority group (here, gay people)” or with statistical evidence. But the appeals court said Ms. Ames had provided neither kind of proof.

    (In the trial court, she said the two supervisors who took negative employment actions against her were straight. On appeal, she said a gay supervisor had also played a role. The appeals court ruled that she had forfeited that argument by not making it sooner.)

    Conservative legal groups had championed Ms. Ames’s case, Ames v. Ohio Department of Youth Services, No. 23-1039. The Biden administration also supported her argument, filing a brief supporting Ms. Ames.

    Correct, Curt. This particular complainant may lose this specific case. The precedent is in the Court's unanimous decision that such a suit is valid.

    It'd be great if our Ivy League law school professor would weigh in.

    The issue at case seems more technical than any sort of victory for heterosexuals or women.

    It seems to me to be about reverse discrimination... and, equality being legal and equity being against the law in the US, but,...

    First, a 9-0 in an absolutely split court is amazing. They're saying that DEI is illegal. So all the folks that believe in reverse discrimination can be assured that meritocracy is alive and well in the US. So maybe people will just have to do their job well, instead of pretending to be something they may not be. Clearly, this is a violation of the constitution.
