"If today the Executive claims the right to deport without due process and in disregard of court orders, what assurance will there be tomorrow that it will not deport American citizens and then disclaim responsibility to bring them home?” wrote Judge J. Harvie Wilkinson III, an appointee of President Ronald Reagan.

In a scathing opinion, the U.S. Court of Appeals for the Fourth Circuit on Thursday rejected the Trump administration’s appeal of an order requiring the government to facilitate the return of a Maryland man it erroneously sent to a mega-prison in El Salvador.

Writing for a three-judge panel, Judge J. Harvie Wilkinson III said the U.S. Department of Justice’s claim that it can do nothing to facilitate Kilmar Armando Abrego Garcia's release from custody in El Salvador should be “shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”



“It is difficult in some cases to get to the very heart of the matter. But in this case, it is not hard at all,” Wilkinson wrote.


“The government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order,” Wilksinson wrote in an opinion Thursday rejecting the government’s request to halt a district court order that it takes affirmative steps to retrieve Abrego Garcia and vacate an order for discovery into these efforts. “Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done.”

    You've wrongly listed what you fantasize are "unconstitutional" rules. Again, it's your TPS speaking. I will (again) agree the first load to el Salvadore was done poorly. AND it hadn't been done in 80 years. AND we didn't deport then. So there's all that. I can understand that even lawyers could rationalize doing this. I believe what SCOTUS did was correct and is a "new" reading to the law. So no problem so far.

    You believe they MUST have a jury trial. I believe in the initial hearing (which has been to a judge only for decades) where the government tells the judge why they are deporting them and ensure they have the right person, etc, the alien (remember, once they're citizens, they can't be deported) can plead their case. If the judge says they can be deported, there is an immigration appeals court already set up. This system has been around since Ellis Island. Most aliens are let in.

    Like I've said numerous times before, If they're rapists, or ax murderers, or wife beaters, they get let in with the initial hearing. No issue. I know you'll jump on the homer bandwagon to defend wife beaters, rapists, murders, and sex offenders (because you have routinely in the past), but a "normal" person anywhere doesn't want a kiddie rapist living next door to them. They get to be declined. And will be declined if they go through the normal, legal channels. Those are the one's you want let in. The "gotaways" as they're called. These are the rapists, gangsters, murderers, sex offenders and rapists you support. Again, the victims of these offenses you're sure to convict in your own sexist, and racist white liberal view. You don't give a shit about those being raped coming in to the country. This is the "superchicken" defense, which you are so proud of. The "Let them be raped because a 14 year old should know she's going to be raped by some asshole who likes a virgin. You deserve to be shot with the coyote, by the victims. You're a piece of shit that should never be allowed to exist in a civilized world.

    Immigration court hearings are closed when:

    The case involves information subject to a protective order;
    The case involves an abused spouse or child, and in the case of an abused spouse, a hearing may be opened to the public with the abused respondent’s consent;
    The case involves a respondent who, based on provisions of the Violence Against Women Act (VAWA), is a beneficiary of an application for relief under specific sections of the Immigration and Nationality Act, among other federal statutes (VAWA is a law that seeks to protect human trafficking victims, abused spouses, abused children, and certain other victims of violence);[2]
    and much more informative.

    The 4th Circuit is more progressive Swampcult than not.

    AND,... as far a Pope Kilmar is concerned, he's received due process, several times over.

    That still doesn't excuse Trump's team for its "administrative error" in sending the Pope to El Salvador. But, in the end, that may turn out to be the equivalent of a no-harm-no-foul situation.

    I'll ask my standard question. Are you lamenting, yet, your personal role in lockstepping with the Dem smoke-filled room in its conspiracy to foist the Day Drinker on the electorate? It's going to be, at the very least, two looooooooong years... for y'all?
