The Supreme Court on Monday threw out a judge's decision to block the removal of men alleged to be members of the Venezuelan gang Tren de Aragua to El Salvador without any legal process under the Alien Enemies Act.
Like curt said the gangsters need time for a habeas corpus hearing to see if the law is applied. They can do this from jail.
The main points were;
1. "An activist judge in Washington, DC does not have the jurisdiction to seize control of President Trump’s authority to conduct foreign policy and keep the American people safe," Attorney General Pam Bondi said on X.
2. Are they members of a transnational gang. (must answer "yes")
3. Are they US citizens. (Must answer "no")
4. Do their actions fall under the Alien Enemies Act (must answer "yes")
My guess is that they'll give everyone an hour or so in court, let prosecution state the case, let them defend themselves and that will be that. Hopefully though, if there's a "wrong person" in the group that'll be found out (a little late, but still before they're back in el Salvadore). So if there are name mixups, etc, that will be one more checkpoint so they don't deport the wrong folks.
