People who argue that the Biden border bedlam is an economic plus for America are bonkers.

According to a release from the Oklahoma State Department of Education, the lawsuit seeks compensation for the “severe financial and operational strain that their failed border policies have placed on Oklahoma’s public schools.”

“Biden Administration leaders utterly abandoned their constitutional duty to secure our nation’s borders, leaving states like Oklahoma to pick up the pieces. Their negligence has been a sad and harmful trademark of the Biden administration and has sent shockwaves across our communities, overburdening schools with unfunded mandates and diverting resources from Oklahoma children.” Supt. Walters said.

The release from Walters’ office points to what it called a connection between the “federal government’s border mismanagement and the skyrocketing costs Oklahoma schools face to accommodate an influx of non-citizen students.”

OSDE highlighted three allegations made in the lawsuit: The alleged cost to Oklahoma taxpayers, the alleged diversion of resources and the alleged neglect of constitutional duty.

    Walters is the loon who has directed "that every teacher, every classroom in the state will have a Bible in the classroom and will be teaching from the Bible in the classroom".

    Like most states, Oklahoma finances education through a combination of state, local, and federal revenue. The state aid funding formula considers factors like student population, characteristics, and district characteristics.

    In other words, school districts are rewarded for having increased student populations with bigger budgets. Those budgets are funded through state taxes, which immigrants pay like everybody else in the form of sales taxes and property taxes which they pay directly or indirectly as part of their rent.

    Seriously, I'm surprised that the Oklahoma thing hasn't been shot down in court already... unless there's something in that last freedom of religion Supreme Court decision?

    This is lawsuit is going nowhere. Walters is reportedly considering a run for governor. This is grandstanding designed to impress the slack jawed yokels in the OK state.

    First off, federal employees are shielded from personal liability due to "qualified immunity". They cannot be sued for acting within the scope of their job duties.

    Second, it is illegal to ask about the citizenship status of a public school student, and undocumented students are guaranteed education by the 1982 Plyler vs. Doe U.S. Supreme Court decision.

    Third, the supposed costs Walters cites are dubious and come from a dubious xenophobic hate group.

    Even current colleagues of Walters in Oklahoma's executive branch are skeptical. "If this lawsuit represented a serious attempt to hold the Biden Administration accountable for its open border policies, it would have been filed by the attorney general," said Phil Bacharach, a spokesman for the [Oklahoma] state attorney general's office.
