It does not have to pass the appeal process. Most definitely not. An appeal is the appeal of a conviction, not a first test of guilt or innocence. There is no automatic right of appeal, either. An Appeal Cort can refuse to hear one if it thinks the conviction had merit. To appeal there has to be at least credible belief that an error has been made. It is the errors that are heard.

True - and by not bestowing any real penalty on Mayor McSleaze - it will be that much easier for an appeals court to deny a appeal.
