Trump knew as early as February that he had classified documents in a non-secure location* at Mar-a-Lago, yet didn't say anything until August about it. --Curt

House Speaker Kevin McCarthy (R-Calif.) on Thursday argued Trump knew his private office had classified documents, or he wouldn’t have had his attorneys remove things from his office.

“I think if you call a lawyer to remove something for your office, he must have known ahead of time,” McCarthy said. “So, I think he has a lot of answers to the American public. The good thing about that is the American public has a Congress that can get the answers.”


Actually, as a public service I slightly edited McCarthy's comments. I am sure he meant to express his outrage that Trump didn't come forward months earlier to admit he was holding onto mishandled classified documents..

In February 2022, the FBI interviewed Trump administration officials and aides at Mar-a-Lago about the handling of presidential records,[39] including former White House Counsel Pat Cipollone and his former deputy Patrick Philbin.

On April 12, 2022, NARA said it would let the FBI access the documents retrieved from Mar-a-Lago. Trump's lawyers sought to delay this outcome.[73] On May 10, Debra Steidel Wall, the acting Archivist of the United States, wrote Trump's attorney M. Evan Corcoran to reiterate that Trump had taken hundreds of pages of classified materials with him, including highly classified Special access programs materials, and that their extended negotiations over alleged executive privilege was delaying investigations and threat assessments already underway. She said that based on legal counsel she had decided not to honor their request for further delays. An ally of Trump made the letter public on August 22.[73][74][75][55] When NARA provided the FBI with access to the records it retrieved, the FBI provided copies to individual agencies of the US Intelligence Community to conduct classification reviews and determine whether their disclosure could put at risk sensitive sources.[76]

On May 11, the DOJ subpoenaed Trump for "any and all documents or writings in the custody or control of Donald J. Trump and/or the Office of Donald J. Trump bearing classification markings".[77][59] Trump's advisers repeatedly urged him to fully comply with the subpoena, despite his desire to keep some documents.


*When FBI agents searched Mar-a-Lago earlier this month, they found classified documents sitting in unsecured locations despite assurances from Donald Trump’s team that any such files taken from the White House had been placed under lock and key. That new revelation comes from The Wall Street Journal.

    Curt- I'd actually agree with that. Therefore, the documents were in a SCIF. I covered this earlier, but it didn't mention the McCarthy thing. And it makes no difference in the laws surrounding the handling of classified material. If you don't know you had it, or forgot about it, but it's in a SCIF, that's actually less of a charge than leaving it in your garage.

    And knowing about it or not doesn't matter. It's about the location of it.

    According the WSJ, the Mar-a-Lago classified documents were NOT in SCIF. Anyway, Trump claimed he unilaterally declassified them so why would he have them in SCIF?

    The FBI said they had to get the keys and codes for the room. I'm taking their word until proven otherwise. If that's true, the same applies.

    What the FBI may have said about keys and codes doesn't contradict what the Wall Street Journal reported. WSJ said that some classified documents were unsecured and outside of any vault, safe or locked room.

    If Trump really had them all safely in a SCIF he wouldn't have needed to claim that he unilaterally declassified them. Plus he had his attorneys including Christina Bobb shuffled through the classified documents. I am guessing she didn't have security clearance.

    You initially said, "the documents." That infers all the documents because you didn't make exceptions. And "some" of the documents could mean two that weren't classified. I don't know that. The keys and codes have a lot to do with a SCIF. Had you ever worked in one, you would know that. Again, you're talking about stuff you've never worked in. The closest thing you've got "knowledge" of is TV and movies.

    AGAIN, I'm not arguing or defending anyone or anything. If the case is what you say, what I said before, still stands. If he's wrong he's wrong. Period. End of fukking story.

    Regarding the "declassification" issue. This is new territory for the US. Typically, the declassification process is a rather lengthy one, and very selective.

    Can the "president" do that? Yeah. it's "legal." Why any president would do that post-president is a mystery to me. And if it's not marked appropriately, it doesn't matter anyway. I'm "assuming" that neither (legally) declassified anything at this point. That's my starting "assumption." And has been since the start. You're getting wrapped around the wheels about something that doesn't really matter in the big scheme of things. You're cutting down the saplings to get to the forest.
