I skimmed through a lot of the testimony. I did watch the attorneys' closing arguments in full which were addressed to the judge as there was no jury.

Kari Lake's lawyers needed to make the case that there was a compelling reason to discount some or all of the votes in Maricopa County and somehow declare her the winner of the gubernatorial election. Her team failed miserably. I will be shocked if the judge, who was appointed by the Republican former governor Jan Brewer, thinks otherwise.

Lake's lawyer in his summation didn't have any examples of election fraud or malfeasance to point to. Rather he focused on the mundane technical glitches that happen (but were noticed and rectified) such as computer "print to fit" issues. He repeated the phrase "your honor, it doesn't make sense" about ten times.

He also expressed umbrage at the defense team (representing the county election officials) suggesting that Lake lost because she advised voters not to vote by mail or early. He said it's insulting to suggest that voters don't have the right to doubt the election system's integrity.

Lake's lawyers also lamely suggested that they would have put together a better argument for Lake if they had more time to produce more witnesses. The witnesses they did have seemed evasive and combative when cross-examined. Their witnesses were the usual collection of MAGA election denying nuts who appear in Mike Lindell's road shows.

    You're a Saint, Curt...though I suspect there's a little bit of a TDS thing goin on, there.

Here is another take on the trial. It coincides with my own. It appeared originally in the Arizona Republic newspaper. The title says it all: Kari Lake’s bombshell goes pfft! Other than to grift their supporters out of more donations I don’t know why these election losers add more losses to their original loss.

I'm uninterested in the trial and haven't followed it even a wee bit. But, my sense is that MAGAs are gleeful about how it's gone.

  4. by Curt_Anderson on December 23, 2022 2:33 pm
Really? They are gleeful about humiliating losses? I disagree.

I find it really interesting that you feel that "mundane technical glitches" are worth anything.

So. Are the "glitches" an operator error? OR are they a development error. OR are they a hardware error? You may have machines that are "blind" to some answers because of an issue with the scanner. This is fairly easily done by programming the line scanner. This is High School stuff. Or maybe you can axk your grandkids.

I don't know how this is going to be turned out. I do know that you dims are mocking her for a viable legal defense. If I were a misogynous pig, I might think the same way.

What? you say you're NOT a misogynous pig? Oh. Okay, you're a racist misogynous pig.

Don't worry, this is what conservatives have put up with for a couple of decades. Get used to it. I'll continually use sheeple stuff on you sheep.

You're saying a person that lives here, does not have the right of due process. Because you disagree with them, they don't have the right to a fair and impartial jury. I will tell you that's because you're nothing but a lily-white racist that hates our Constitution.

    Olde Dude,
Have you never had your computer screw up something in a way that's unexpected and unexplained? It doesn't mean there was a conspiracy against you? There is a reason that states have automatic recounts when they are within .5% or 1% differences. Usually, but not always, the recounts don't change the outcome of the election, but often the counts change. They have these recounts because states realize that elections are subject to possible human mistakes, computer glitches, ballots that are stuck to another, all sorts of innocent and non-conspiratorial errors. That's why they doublecheck.

Scott Jarrett, the county’s co-elections director, testified on Thursday that temporary technicians dispatched on Election Day to troubleshoot problems in three vote centers accidently set the printers to shrink-to-fit, causing the vote center tabulators to reject them.

What he described was a snafu, not a scheme.

But Lake’s expert, Clay Parikh, said those 19-inch ballots turned up in ballots he inspected earlier this week from all six vote centers and thus it “could not be by accident.”

    Ipso facto, a conspiracy-o.

Who knows? Maybe it would have worked in fantasyland. But here in Maricopa County, there are those bipartisan boards that make sure such ballots count. So even if there was a plot (doubtful), it was foiled when those votes were ultimately counted.

In a decision that should surprise nobody....

PHOENIX — A judge has thrown out Republican Kari Lake's challenge of her defeat in the Arizona governor's race to Democrat Katie Hobbs, rejecting her claim that problems with ballot printers at some polling places on Election Day were the result of intentional misconduct.

In a decision Saturday, Maricopa County Superior Court Judge Peter Thompson, who was appointed by then-Republican Gov. Jan Brewer, found that the court did not find clear and convincing evidence of the widespread misconduct that Lake had alleged had affected the result of the 2022 general election.

The judge said Lake's witnesses didn't have any personal knowledge of intentional misconduct.

"The Court cannot accept speculation or conjecture in place of clear and convincing evidence," Thompson said.

I wasn't at all surprised by the ruling. Lake's case was so obviously weak. So tired of sore loserism which started with Trump and the MAGAs.

FIRST. I'm really wondering if you actually read my posts. As usual, I'm in the middle here. Would I want Lake to win? sure. But if the facts dictate she doesn't, then I'm okay with that. I do think a recount should also examine the ballots to be valid. If this was done or not is up to the AZ state constitution and law. I don't know enough about that to make a decision.

I respect the judge throwing the lawsuit out. I'm not familiar with what's going on in the specific case and what was said in court. I also support the right to appeal. At times, it's at least arduous and bullsht, but that's the system.

Curt- I honestly am not picking fights. You've said a lot of stuff the past couple of days that is even out of your control. Looking at both sides is not a sheeple idea, I understand that. Obviously, it's also not in your wheelhouse. But it is mine.

Due process is a two-way street. Plaintiffs have rights but so do defendants.

Lake's lawyers should not have brought her case to court unless they could prove that there were more than 17,200 votes for Lake that were uncounted. They couldn't even prove that any votes were uncounted. Having a collection of half-baked conspiracy theories and suspicions don't add up to evidence.

I predict Lake won't win on appeal---that's if it's even heard. There needs to be legitimate reason for an appeal. Not liking the judge's decision and/or the results of an election isn't sufficient grounds.

holyfuk. Yes, I agree. Why are you trying to sharpshoot me. You have been arguing the exact opposite. So you have no where to go but to take one remark in to antithesis. Those are the legal steps. Again, there are time when it's a PITA. On both sides. That's the game. You play the game until you're out of money or courts.

UPDATE: Katie Hobbs seeks sanctions against Kari Lake after Arizona judge dismisses election challenge lawsuit

Attorneys for Hobbs, who has served as Arizona's Secretary of State for the past four years, joined the county in its filing Monday seeking $25,050 from Lake, which includes attorney fees for the state's most populous county and Hobbs. The county took aim at Lake’s remarks before the election indicating she would not accept the results unless she won, as well as her “groundless” and “frivolous” lawsuit after the election was certified.

“Before a single vote was counted in the 2022 general election, Kari Lake publicly stated that she would accept the results of the gubernatorial election only if she were the winning candidate,” the county said in the filing.

“But she has not simply failed to publicly acknowledge the election results. Instead, she filed a groundless, seventy-page election contest lawsuit against the Governor-Elect, the Secretary of State, and Maricopa County and several of its elected officials and employees (but no other county or its employees), thereby dragging them and this Court into this frivolous pursuit.”

The county added that the courts “should not be used to harass political opponents and sow completely unfounded doubts about the integrity of elections.”

“Enough really is enough,” the county said. “It is past time to end unfounded attacks on elections and unwarranted accusations against elections officials. This matter was brought without any legitimate justification, let alone a substantial one.”

I think "sanctions" are a tad over the top, Lake needs to just accept the results.

The ONLY exception is if she would have evidence that would prove wrongdoing. So far it's a lot of innuendo. And you always lead with your best case.

I think Hobbs should have recused herself, but the state courts let it go through.

Lake tried, got shot down. Time to work on the next election, or whatever she's going to do.

As for Lake and that quote prior to the election. Get a filter.
