Truth is an absolute defense to libel/slander claims, because one of the elements that must be proven in a defamation suit is falsity of the statement. CNN will attempt to convince the court that their reporting on the election outcome is true. Trump will need to prove that he really won the election but was denied the win because of fraud. Five bucks says Trump won't and can't. I know that CNN isn't too worried.

Notice that Trump's lawyers are familiar with Kierkegaard. They speak of Trump's "subjective belief", in other words an opinion without any supporting evidence or facts.

Trump notifies CNN of 'intent to file' defamation lawsuit regarding his unproven election claims

“I have notified CNN of my intent to file a lawsuit over their repeated defamatory statements against me,” Trump's statement said. “I will also be commencing actions against other media outlets who have defamed me and defrauded the public regarding the overwhelming evidence of fraud throughout the 2020 election.”

In a letter dated July 21, 2022, and addressed to CNN's CEO Chris Licht and executive vice president and general counsel David Vigilante, lawyers for Trump cited numerous examples in which they maintain the former president was defamed.

“Accordingly, I hereby demand on behalf of President Donald Trump that CNN (1) immediately take down the false and defamatory publications, (2) immediately issue a full and fair retraction of the statements identified herein in as conspicuous a manner as they were originally published, and (3) immediately cease and desist from its continued use of ‘Big Lie’ and ‘lying’ when describing President Trump’s subjective belief regarding the integrity of the 2020 election,” the letter stated.

    Curt,

Notice that Trump's lawyers are familiar with Kierkegaard. They speak of Trump's "subjective belief", in other words an opinion without any supporting evidence or facts.

On behalf of the pb/Kierkegaard partnership, I thank you for the shout out.

Your TDS is showing, there, Curt. Subjectivity is truth for everyone, not only OrangeMan.

Subjectivity...and OrangeMan gets this...is also truth for Bill Barr.

Trump's case against the progressive SwampMedia is solid. Lizzy's contention is that Trump was lying about the stolen election because Barr told him of his BELIEF that the election wasn't stolen. And, the SwampMedia took that as gospel.

You know what a narcissist Trump is. If anyone around him was...is...still saying that the election was stolen, that feeds his narcissism and Trump’s going to believe that.

Trump's trumps in a lawsuit against CNN. CNN had better get out its check book now.

  2. by Curt_Anderson on July 28, 2022 8:36 am
Barr and other rationale people don't just simply have a "belief" that the election was not stolen. Rational people know that there is no evidence that the election was stolen.

As Rudy Giuliani told Rusty Bowers about supposed election fraud in Arizona, "we don't have any evidence but we have theories".

"Trump's trumps in a lawsuit against CNN. CNN had better get out its check book now." - Hts

LOL! You seriously believe Trump will be able to prove his case?

I think we need to redefine TDS as a mental affliction commonly seen in Trump supporters and apologists.

  4. by HatetheSwamp on July 28, 2022 10:14 am

LOL! You seriously believe Trump will be able to prove his case?

Donna, of course, Trump will be able to prove his case.

Actually, CNN, it seems to me, will have to prove it can read Trump's mind. And, got it, I know progressives think they're omniscient. But, you're not, really.

    What's at issue is this:

"President Trump’s subjective belief regarding the integrity of the 2020 election.”

This has nuthin at all to do with the election being stolen. It's about CNN claiming that Trump's lying when he says he believes the election was stolen.

Trump's not lying. He really believes it. Proving he doesn't will be difficult.

  5. by Curt_Anderson on July 28, 2022 10:25 am
Within ten days we will know if Trump is lying about his lying. I predict that Trump won't bow to Trump's "subjective belief". I further predict that ten days will come and pass and Trump won't sue CNN.

"Trump’s spokesperson says if CNN doesn’t make a formal apology within 10 days for defaming him about the 2020 election and J6, he will sue the network."
    See video below...

Btw, Trump promoting OAN is in their death throes. Their TV viewership has dwindled dramatically. Verizon and DirecTV just dropped OAN. OAN will now be left with only minor carriers.

    Donna,

Please don't try to live inside Trump's brain...as, apparently, you are.

Nuthin good can come of it.

I think CNN is calling his bluff.

  11. by Curt_Anderson on July 30, 2022 2:50 pm

In pot-calling-the-kettle-black news, I like how she shamelessly says that CNN shouldn't make claims without "researched, well-founded facts"...you know, like Trump always does.

Notice that after she announces Trump will sue CNN, she adds almost under her breath, "I believe".

Scare tactics, except no one's scared.

  13. by HatetheSwamp on July 31, 2022 4:10 am

I think CNN is calling his bluff.

    Donna,

Name a politician more arrogant and confrontational than OrangeMan. What could it possibly mean to call his bluff?

  14. by Donna on July 31, 2022 8:22 am
    Definition of call someone's bluff

: to challenge someone's statement or threat because it is not believed.

// When she threatened to quit her job, her boss called her bluff and told her she could leave if she wanted to.

    merriam-webster.com

  15. by HatetheSwamp on July 31, 2022 8:45 am

    Donna,

To use your poker metaphor. I don't think Trump is bluffing.

I don't think he does bluffing. Whatever your opinion of J6, there was no bluffing going on there.

  16. by Donna on July 31, 2022 8:53 am
    We're both guessing.

  17. by HatetheSwamp on July 31, 2022 8:54 am

We both are. But, I bothered to listen to what Trump said about the potential suit against CNN. My guess is educated at least.

  18. by Donna on July 31, 2022 9:09 am
Why threaten, though? We not just go ahead and sue? That's why I think he's bluffing.

  19. by HatetheSwamp on July 31, 2022 9:14 am

Donna, the man is a narcissist. He has us talking about his lawsuit before the suit is even on the table.

The thing that many GOPs despise about Trump is that, with Trump, ultimately, everything is about Trump, always.

I actually thought about that but, Donna, you're obsessed!

Trump is a deal maker. No doubt, he'll threaten a lawsuit to bludgeon his opponent to cry uncle.

I don't see that happening here and I'm pretty sure that Trump doesn't, either.

  22. by Donna on July 31, 2022 9:50 am
You don't see what happening here?

  23. by Curt_Anderson on July 31, 2022 9:56 am
Who remembers when Republicans were against “junk lawsuits” and “frivolous lawsuits” and championed the need for “tort reform” to overcome the sinister powers of “the trial lawyers”?

  24. by HatetheSwamp on July 31, 2022 9:58 am

Donna, no. I don't think CNN will cry UNCLE !

  25. by Donna on July 31, 2022 10:02 am
Of course CNN won't cry uncle. They aren't stupid.

So you still think in that event Trump'll go through with his lawsuit?

  26. by HatetheSwamp on July 31, 2022 10:21 am

    I suspect that he will.

  27. by Donna on July 31, 2022 10:40 am
Well longshots occasionally win in horse races.

The odds predict, though, that it's highly unlikely.

  28. by HatetheSwamp on July 31, 2022 11:12 am

There's a line on it in Vegas?

  29. by Donna on July 31, 2022 11:30 am
If there were, lawsuit would pay off very well.

  30. by Curt_Anderson on July 31, 2022 12:19 pm
Maybe Vegas is not taking bets, but in my opening post I wrote, "Trump will need to prove that he really won the election but was denied the win because of fraud. Five bucks says Trump won't and can't. I know that CNN isn't too worried."

  31. by HatetheSwamp on August 1, 2022 4:42 am

    Curt,

Where do you get that Trump will have to prove that he won the election?

You yourself even made the Kierkegaard joke. This is about Trump’s subjective belief and the SwampMedia's claim that he doesn't really believe that the election was stolen.

As I said, pb took the time to listen to what Trump actually said about the suit when he was interviewed by Clay and Buck. He's been mentioning, in his speeches, in bits and pieces, his proof that the election was "rigged and stolen." He told Clay and Buck that he'll use this lawsuit to make his case.

  32. by oldedude on August 1, 2022 8:38 am
This sounds exactly like what the LWO sheep did with Palin. She finally got out because she was taking so much time with them and the cost was the same thing as Flynn.
What's good for the gander is good for the goose.

  33. by Curt_Anderson on August 1, 2022 9:19 am
"Where do you get that Trump will have to prove that he won the election?" --HtS

You have heard of "stolen valor". It is when impostors pretend to have won military honors. Let's say I decide to march in local parades with ribbons and medals I picked up at a pawn shop and fabricated in my metalworking shop. Somebody might call me a fraud and a phony. Maybe the local newspaper investigates and discovers I am not a war hero.

In my embarrassment, I might decide to sue for defamation. Whoever I sue could simply win their case by showing that there are no reports of Curt Anderson having won the Distinguished Service Cross, the Navy Cross, the Presidential Medial of Freedom, the Silver Star and the Croix de Guerre. As I said truth the best defense against charges of slander and libel.

However, if I could prove that the military DID have me on record as having won all those medals and honors, I could possibly win my defamation lawsuit. It would not be good enough for me to subjectively believe that I really, really deserved the military honors or that I was unfairly cheated out of having those honors.

It's the same with Trump, he'd have to prove he won the election to refute the claim that he is lying about it.

  34. by HatetheSwamp on August 1, 2022 11:12 am

    Curt,

The plaintiff gets to choose the battleground in a civil suit. The battleground here is whether or not Trump really holds to his subjective belief or if he's lying about it.

  35. by Curt_Anderson on August 1, 2022 11:30 am
    HtS,
Where'd you get the idea that the plaintiff "gets to choose the battleground" in a defamation case? I know you think that means that the plaintiff has the right to "their own truth" as opposed to accepted, objective reality.

  36. by HatetheSwamp on August 1, 2022 12:26 pm

No, Curt, but in a civil case there is a complaint which defines the issue at hand.

According to your own words, CNN's "continued use of ‘Big Lie’ and ‘lying’ when describing President Trump’s subjective belief regarding the integrity of the 2020 election...” is what is at issue.

If Trump files the suit, that's what it's going to be about.

CNN regularly asserts that Trump is lying when he says he believes that the election was rigged and stolen.

  37. by Donna on August 14, 2022 6:56 am
What's the latest on Trump's lawsuit against CNN, Hts?

  38. by HatetheSwamp on August 14, 2022 7:12 am

    Donna,

I've been thinking about that, too.

One thing that Big Brother has that even the most wealthy citizens have is, for all practical purposes, unlimited legal resources.

There are many questions that we who hate the Swamp are asking about this ridiculous, heavy-handed, unwarranted raid on the home of the man most likely to oppose the sitting President in the next election. And, why now?

One of those questions is, essentially, your question here. Was at least part of the reason for this raid, at the time the CNN suit was about to be filed, an attempt to tie up Trump's legal resources so that Trump can't afford to sue CNN?

Trump suggested that he would use the trial, against a key outlet of the SwampMedia, to present his evidence of substantial vote fraud in the election.

Was the raid on Trump's home, which will involve all the legal resources Trump can muster, an attempt to prevent Trump from making his case to the American people?

I, for one, am suspicious...but, if that's the case, it's unlikely that that truth will ever be known.

  39. by Donna on August 14, 2022 7:57 am
Really, Hts? That's all you have - a conspiracy theory?

What interest would the DoJ have in protecting CNN?

Trump's threat of a lawsuit against CNN was obviously just the latest in a long string of lawsuit threats going back several decades. I posted that long list on this thread. He's only followed through with lawsuits in six of those threats.

    Good God you're a chump.

  40. by Curt_Anderson on August 14, 2022 10:10 am
"CNN had better get out its check book now." --HtS

Wouldn't it have been cheaper for CNN to hire some defense lawyers? It must have cost a fortune to Merrick Garland, the DOJ and the FBI to search Mar-a-Lago. And there was no guarantee that it would distract Trump from his defamation lawsuit.

  41. by HatetheSwamp on August 14, 2022 1:39 pm

What interest would the DoJ have in protecting CNN?

Oh, maybe you've never read a pb post before. One word: Swamp.

Every bit of establishment DC has been aligned against Trump since his campaign took off in 015. And, from the Russia hoax right on to today.

  42. by oldedude on August 14, 2022 7:46 pm
Gutfeld repeated the line, "we need to delete "IF THIS IS TRUE THEN..." out of the English language... This is how all the felonies in the first two "impeachments" were. They ended up with some bullshit that was fantasy.

  43. by Curt_Anderson on August 14, 2022 8:03 pm
5+3=8. IF THIS IS TRUE THEN 3+5=8 and 8-3=5. I find the phrase handy.

If it is true that Gutfield said that, then I agree don't with him.

  44. by oldedude on August 14, 2022 8:12 pm
It's actually all about all the stupid shit that people like little nancy, shifty et.al. has said about the felonies they have never come up with. Yet, there IS INDISPUTED EVIDENCE MAJOR CRIMES HAVE OCCURED. And yet haven't been able to prove one. So they lie and make up something out of their hatred. That's what we were saying about the J6 trial, unless they can't prove anything, then it will just be a "committee."

  45. by Donna on August 14, 2022 9:47 pm
Hts, I find it fascinating that while you're always reminding us how "dispicable" Trump is, you always come to his defense crying Goodness gracious, Trump could never be guilty of what he's being accused of. Heavens no! It must be a conspiracy. Yes, that's it! It can't be anything else!

Good grief, who steals over 15 boxes of official government documents, stashes them in his home, and lies about having them all, I guess secretly, declassified after his own lawyer turns over some of them that are marked "classified"?

Who does that? And why is it always the same people who fall for his bullshit?

I guess that's why I keep coming here - to watch the freak show close up.

    Fascinating, simply fascinating.

    Donna,

TDS to me is allowing Trump to undermine democracy and to get away with breaking the law.

"Please don't try to live inside Trump's brain...as, apparently, you are."
Actually Trump lives in her head. She can't think rationally because of it. Or remember back to June...

"Good grief, who steals over 15 boxes of official government documents, stashes them in his home, and lies about having them all, I guess secretly, declassified after his own lawyer turns over some of them that are marked "classified"?"
So you've seen these boxes? You've seen the classification or at least the markings indicating they are 1. government documents and 2. Classified government documents.

TDS to me is allowing Trump to undermine democracy and to get away with breaking the law.
Show me the evidence the law was broken. Hard fact. Only at Mar-a-Largo.
