"Partial birth abortion" is a political term, not a medical one. Contrary to the image the term conveys, it does not happen in the final days of a nine month gestation period. When they were legal, the vast majority of such abortions happened between the 20th and 24th week.
The U.S. Supreme Court upheld a federal version in 2007 in Gonzales v. Carhart. That law, which applies across the country, bans “partial-birth” abortion except when the pregnant person's life is endangered and does not contain an exception to protect the patient's health.
The WHPA does not mention or allude to partial birth abortion. There is no call by Democrats to undo current federal law.
