In a nutshell, Trump's legal team is arguing that since Trump is leading in the polls, the Supreme Court should ignore a constitutional amendment, the 14th. That seems like a stretch to expect SCOTUS to bend to the will of popular opinion as determined by polls.

According to polls most Americans want stricter gun controls, even though these proposed gun control measures are at odds with the 2nd Amendment. I cannot imagine SCOTUS undoing the 2nd Amendment or making any other decision based on presumed popular opinion.

Some here think that I have clerked for a Supreme Court justice. I really haven't! But to me, arguing to SCOTUS that current polls are relevant and should be the basis for a decision seems desperate not to mention insulting.

(CNN)Former President Donald Trump on Monday urged the Supreme Court to keep his name on Colorado’s ballot, accusing his challengers of pursuing an “anti-democratic” legal case against him, in the final written argument he’s expected to make before the justices hear oral arguments in the case this week.

“He is the presumptive Republican nominee and the leading candidate for President of the United States,” Trump’s attorneys told the Supreme Court in the brief. “The American people – not courts or election officials – should choose the next President of the United States.”

    pb's Legal Advisors suggest that this is precisely the argument that will resonate with Chief Justice Roberts, understanding what he wants his Court to be.

    Remember how the Supreme Court refused to hear how many dozen cases Trump brought in the aftermath of the 020 election!!!!!?

    Despite your own experience working for the Court in the past, you should know how this works. It's unlikely that this reasoning will be stated in the majority opinion, but Roberts didn't want the Supreme Court to settle the election in 020 and he won't want it to this time around either.

    Ain't!!!!!

    Not sure that's a valid synopsis of what happened in 2020 or that it applies here. The election was already "settled" - the Clowns merely confirmed it was already settled.
