    She has it down to within a few months, basically wintertime. She stated that Donald Trump had sexually assaulted her in late 1995 or early 1996 in the Bergdorf Goodman department store in New York City.

    Trump isn't attempting the defend his defamatory remarks with any sort of affirmative defense. He argued unsuccessfully that presidential immunity protects him from lawsuits.

    I've said, from the beginning, that her case is extremely weak. And, if it had not been made in New York, ol E. Jean would have had great difficulty in getting a judgment.

    Trump could have presented evidence that he was out of town during some or all of the period he allegedly raped her. He didn’t. That she couldn’t nail down the date is point in favor of the defense.

    That other women testified Trump assaulted them helped the plaintiff’s case. That Trump said Carroll is “not his type” then mistook her for his ex-wife helped the plaintiff.

    To win a civil case, a plaintiff must convince the jury by “a preponderance of the evidence.” Simply said, a plaintiff must prove that there is a greater likelihood than not that the defendant did something wrong.

    Do you really think it is unlikely that the pussy grabber forced himself on her?

    How was he supposed to do that without a timeline? That doesn't make sense. If I don't have a year (even in my boring life) I could have been in Germany, Panama, Costa Rica, Guatamala, Nepal, India, Thailand, Japan, ROK, Saudi, Kuwait, UAE, Somewhere undisclosed in either the Pacific, Atlantic, or Indian Ocean, Qatar, Afghanistan, Iraq, or Iraq, Afghanistan, or Oman. and those aren't even the places I went on leave. That's another, say dozen, dozen and a half countries? And I'm not trumpster with my own jet.

    The case wasn't a rape case; it was a defamation case. As with any case, it is the jury's job to evaluate the credibility of the witnesses. Trump did not impress them as being very credible.

    Trump denied that he had ever met Carroll, accused her of "totally lying" and that "she's not my type."

    Here is where Trump shoots himself in the foot: Trump was shown this photograph, he mistakenly identified E. Jean Carroll as his second wife, Marla Maples, despite his first wife Ivana Trump also being in the picture; upon recognizing his mistake, he protested that the photo was "very blurry" (the photo is not blurry).

    Exactly, OD. And, I have noted repeatedly, Alan Dershowitz is confident that, for all practical purposes, this will be set aside.

    The TrumpHate theory was that these civil judgments would hurt Trump with moderate and independent voters. Curiously, it seems to have helped.
