Trump's sacrilegious Bible scam. If people don't recognize Trump as a phony now, they never will.

"Minneapolis Public Schools To Fire White Teachers First Thanks To Teachers Union"

A contract between a Minneapolis public school district and teachers’ union calls for white teachers to be fired before minority teachers, according to the contract obtained by the Daily Caller.

On March 25, the Minneapolis Federation of Teachers and the Minneapolis Public Schools struck a deal to end a 14-day union strike. The deal included a bargaining agreement for various proposals, including one that fires educators based on their race, according to AlphaNews.

Soooo... What is SCOTUS going to do? Because the Teacher's "Union" is strong enough to take this to them. I know this is a hard question for several of you. Does the US/ State Constitution over-rule a Union Contract? Or not. Post your "feelings"

America is a representative democracy and a constitutional republic. Although, I rather liked the way my side of the country was called "the Union" during the Civil War.

People can enter into pretty much any contract with any stipulations as long as neither party is breaking the law.

The agreement, which was reached to end a two-week teacher strike last spring, says that starting this school year, "if excessing a teacher who is a member of a population underrepresented among licensed teachers in the site, the district shall excess the next least senior teacher, who is not a member of an underrepresented population."

Excessing teachers is the process by which staff are reduced at a particular school due to a drop in enrollment, funding or other reasons.

That didn't answer the question. Does the contract hold, or does the constitution hold?

Apparently the contract holds. I don't believe it is at odds with the Constitution. I suppose that if there an argument to be made, somebody will take it to court.

HOLYFUCKINGSHIT! Really? have you not heard of Title VII? or the Civil Rights Act of 1964??????
Man, you are a walking dinosaur and have not been in the workforce since 1970.

I'm going to do this slow, so you can understand.
    1. They freed your nigras
    2. You can't slap your secretary on the ass or call her baby, or demand sex with her for her job.
    3. Yes, you have to hire the darkies. Those dirty Mexicans (regardless of what country they're from), Sand nigs (from the Middle East, and Central Asia) meaning Iraq, Afghanistan, Qatar, Oman, and all they other countries the cave dwellers are from.
    4. Here are the groups you have to feel are "equal" to you. Race, Color, National Origin, Religion, Sex, age, Familial Status, Disability.
Now included in this are gays and trans. There are a load of things to learn (or maybe you don't care). See below. And there are many others.

BTW, Like I've said many times before. I have served with, and under all of these. I have supervised and commanded all of these. I still stand with MLKJr. I see the Character of a person's soul, rather than the color of their skin. I know that violates your "woke" generation but suck it up buttercup.

    OD,
Alert me if somebody there decides to file a lawsuit to challenge the agreement between the Minnesota Public Schools with its teachers' union on constitutional grounds.

My bet is that I'll forget it by then, because you don't really matter.

  8. by oldedude on August 15, 2022 9:17 pm
Curt- just as an interested party. Can you explain your decision/ response out? I know there's a couple of ways of looking at this, so i'm just interested in learning.

Well, I would be a dick if I denied a request as politely stated as that.

I basing my view on my understanding of the Constitution, in particular Article I, Section 10.

    Article I Legislative Branch
    Section 10 Powers Denied States
Clause 1 Treaties, Coining Money, Impairing Contracts, etc.
No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.

I take that to mean that the state cannot challenge an agreement between parties. I suppose that somebody could contest a contract, especially one that is poorly or ambiguously written and have it adjudicated.

I don't know if the Daily Caller writer's assessment of the situation is correct ( it could be - I don't know,) but unlike most people who identify as liberal or progressive, I'm opposed to "affirmative action".

This was the easiest for me to grab at the moment. It was also run in several other papers, mostly in the north-central, or northeast area of the country. I thought I saw one from the NYT. It appeared they all got their story from single source.
