Truth is an absolute defense to libel/slander claims, because one of the elements that must be proven in a defamation suit is falsity of the statement. CNN will attempt to convince the court that their reporting on the election outcome is true. Trump will need to prove that he really won the election but was denied the win because of fraud. Five bucks says Trump won't and can't. I know that CNN isn't too worried.

Trump notifies CNN of 'intent to file' defamation lawsuit regarding his unproven election claims

“I have notified CNN of my intent to file a lawsuit over their repeated defamatory statements against me,” Trump's statement said. “I will also be commencing actions against other media outlets who have defamed me and defrauded the public regarding the overwhelming evidence of fraud throughout the 2020 election.”

In a letter dated July 21, 2022, and addressed to CNN's CEO Chris Licht and executive vice president and general counsel David Vigilante, lawyers for Trump cited numerous examples in which they maintain the former president was defamed.

“Accordingly, I hereby demand on behalf of President Donald Trump that CNN (1) immediately take down the false and defamatory publications, (2) immediately issue a full and fair retraction of the statements identified herein in as conspicuous a manner as they were originally published, and (3) immediately cease and desist from its continued use of ‘Big Lie’ and ‘lying’ when describing President Trump’s subjective belief regarding the integrity of the 2020 election,” the letter stated.

    Trump's case against the progressive SwampMedia is solid. Lizzy's contention is that Trump was lying about the stolen election because Barr told him of his BELIEF that the election wasn't stolen. And, the SwampMedia took that as gospel.

    You know what a narcissist Trump is. If anyone around him was...is...still saying that the election was stolen, that feeds his narcissism and Trump’s going to believe that.

    Barr and other rationale people don't just simply have a "belief" that the election was not stolen. Rational people know that there is no evidence that the election was stolen.

    As Rudy Giuliani told Rusty Bowers about supposed election fraud in Arizona, "we don't have any evidence but we have theories".

    Actually, CNN, it seems to me, will have to prove it can read Trump's mind. And, got it, I know progressives think they're omniscient. But, you're not, really.

    What's at issue is this:

    "President Trump’s subjective belief regarding the integrity of the 2020 election.”

    This has nuthin at all to do with the election being stolen. It's about CNN claiming that Trump's lying when he says he believes the election was stolen.

    Trump's not lying. He really believes it. Proving he doesn't will be difficult.

    Within ten days we will know if Trump is lying about his lying. I predict that Trump won't bow to Trump's "subjective belief". I further predict that ten days will come and pass and Trump won't sue CNN.

    Where do you get that Trump will have to prove that he won the election?

    You yourself even made the Kierkegaard joke. This is about Trump’s subjective belief and the SwampMedia's claim that he doesn't really believe that the election was stolen.

    As I said, pb took the time to listen to what Trump actually said about the suit when he was interviewed by Clay and Buck. He's been mentioning, in his speeches, in bits and pieces, his proof that the election was "rigged and stolen." He told Clay and Buck that he'll use this lawsuit to make his case.

    You have heard of "stolen valor". It is when impostors pretend to have won military honors. Let's say I decide to march in local parades with ribbons and medals I picked up at a pawn shop and fabricated in my metalworking shop. Somebody might call me a fraud and a phony. Maybe the local newspaper investigates and discovers I am not a war hero.

    In my embarrassment, I might decide to sue for defamation. Whoever I sue could simply win their case by showing that there are no reports of Curt Anderson having won the Distinguished Service Cross, the Navy Cross, the Presidential Medial of Freedom, the Silver Star and the Croix de Guerre. As I said truth the best defense against charges of slander and libel.

    However, if I could prove that the military DID have me on record as having won all those medals and honors, I could possibly win my defamation lawsuit. It would not be good enough for me to subjectively believe that I really, really deserved the military honors or that I was unfairly cheated out of having those honors.

    It's the same with Trump, he'd have to prove he won the election to refute the claim that he is lying about it.

    According to your own words, CNN's "continued use of ‘Big Lie’ and ‘lying’ when describing President Trump’s subjective belief regarding the integrity of the 2020 election...” is what is at issue.

    If Trump files the suit, that's what it's going to be about.

    CNN regularly asserts that Trump is lying when he says he believes that the election was rigged and stolen.

    I've been thinking about that, too.

    One thing that Big Brother has that even the most wealthy citizens have is, for all practical purposes, unlimited legal resources.

    There are many questions that we who hate the Swamp are asking about this ridiculous, heavy-handed, unwarranted raid on the home of the man most likely to oppose the sitting President in the next election. And, why now?

    One of those questions is, essentially, your question here. Was at least part of the reason for this raid, at the time the CNN suit was about to be filed, an attempt to tie up Trump's legal resources so that Trump can't afford to sue CNN?

    Trump suggested that he would use the trial, against a key outlet of the SwampMedia, to present his evidence of substantial vote fraud in the election.

    Was the raid on Trump's home, which will involve all the legal resources Trump can muster, an attempt to prevent Trump from making his case to the American people?

    I, for one, am suspicious...but, if that's the case, it's unlikely that that truth will ever be known.

    What interest would the DoJ have in protecting CNN?

    Trump's threat of a lawsuit against CNN was obviously just the latest in a long string of lawsuit threats going back several decades. I posted that long list on this thread. He's only followed through with lawsuits in six of those threats.

    Wouldn't it have been cheaper for CNN to hire some defense lawyers? It must have cost a fortune to Merrick Garland, the DOJ and the FBI to search Mar-a-Lago. And there was no guarantee that it would distract Trump from his defamation lawsuit.

Yet, there IS INDISPUTED EVIDENCE MAJOR CRIMES HAVE OCCURED. And yet haven't been able to prove one. So they lie and make up something out of their hatred. That's what we were saying about the J6 trial, unless they can't prove anything, then it will just be a "committee."

    Good grief, who steals over 15 boxes of official government documents, stashes them in his home, and lies about having them all, I guess secretly, declassified after his own lawyer turns over some of them that are marked "classified"?

    A federal judge in Florida on Friday dismissed a $475 million defamation lawsuit former President Donald Trump brought against CNN that accused the network of defaming him by using the phrase “the big lie” and allegedly comparing him to Adolf Hitler.

    District Judge Raag Singhal, a 2019 appointee of Trump’s, said that use of the phrase or similar statements are opinion that don’t meet the standard for defamation.

    “CNN’s use of the phrase ‘the Big Lie’ in connection with Trump’s election challenges does not give rise to a plausible inference that Trump advocates the persecution and genocide of Jews or any other group of people. No reasonable viewer could (or should) plausibly make that reference,” Singhal wrote.
