"The jury returned a verdict of guilty against Bannon for two counts of Contempt of Congress.

I once informed a client about the Cardinal Rule of Power Struggles: Never get into a power struggle with people who have more power than you do. Steve Bannon could have used that advice. (I have found that teenagers can sometimes benefit from this advice as well.)

After the jury returned its verdict, I answered a few questions on social media. This was my area of practice, so I can speak with some confidence: Most issues on appeal give deference to the trial court’s decision. It’s not enough to make a good argument that the court messed up. You must show that the court abused its discretion. Steve Bannon will lose. Being charged and convicted of contempt is punishment for having failed to comply. It is not an attempt to get him to comply. In other words, it’s punishment, not a means for securing compliance.

Right. But my guess is that Steve Bannon (and Peter Navarro) would be totally useless as witnesses anyway. If they did talk, you’d never believe a word. If they talked to the J6 committee, they’d just try to jerk them around.

Documents are usually not covered by the 5th Amendment, so the DOJ would have options for getting those.

Steve Bannon was never going to talk. People with criminal liability don’t have to. But instead of going in and standing on the Fifth, he thumbed his nose at Congress. See my earlier tweet about the Cardinal Rule of Power Struggles."

    I am sure that Bannon's conviction sobered Peter Navarro and others who considered using the same nose-thunbing tactics as Bannon. Navarro has already pled poverty in not being able to afford a lawyer. That means he can't afford a legal appeal either. Nor do the "50, 60 and 70 year-old men", as Liz Cheney termed them, relish the likely possibility of jail time.

    I predict the taciturn witnesses will suddenly become more accessible and compliant with the committee.

    "I only have one disappointment, and that is the gutless members of that show-trial committee, that [Jan. 6] committee, didn't have the guts to come down here and testify," Bannon said.

    There is a lot of hypocrisy to unload in the above statement.
    1. Bannon found himself in this mess because he didn't testify before the committee. (He could have appeared and taken the Fifth to all questions).
    2. Bannon didn't testify in his own trial.
    3. The committee members were not subpoenaed to testify.

    Since we're discussing Bannon...

    On the evening of October 31, 2020, Steve Bannon told a group of associates that President Donald Trump had a plan to declare victory on election night—even if he was losing. Trump knew that the slow counting of Democratic-leaning mail-in ballots meant the returns would show early leads for him in key states. His “strategy” was to use this fact to assert that he had won, while claiming that the inevitable shifts in vote totals toward Joe Biden must be the result of fraud, Bannon explained.

    “What Trump’s gonna do is just declare victory. Right? He’s gonna declare victory. But that doesn’t mean he’s a winner,” Bannon, laughing, told the group, according to audio of the meeting obtained by Mother Jones. “He’s just gonna say he’s a winner.”

    “He’s gonna declare victory. But that doesn’t mean he’s a winner.”

    “As it sits here today,” Bannon said later in the conversation, describing a scenario in which Trump held an early lead in key swing states, “at 10 or 11 o’clock Trump’s gonna walk in the Oval, tweet out, ‘I’m the winner. Game over. Suck on that.'”

    And then it happened exactly like Bannon predicted.

    I, and I'm sure everyone on this forum knew that Trump was going to automatically claim fraud if he lost. And that happened too.
