Terms and Conditions of SelectSmart.com's Free and Plus Selectors

1. Agreement. This is an agreement between you and SelectSmart.com ("SelectSmart.com") regarding your enrollment into and use of the SelectSmart.com Free and/or Plus Selectors service (as defined below). This agreement governs the terms and conditions under which SelectSmart.com makes its SelectSmart.com Free and/or Plus Selectors service available to individuals, web masters and owners of web sites.

2. Minimum Age Requirement. YOU MUST BE AT LEAST 13 YEARS OLD to use or register for services and programs.

3. Online Conduct. As a member of any SelectSmart.com Free and/or Plus Selectors service, you agree and warrant that: You are solely responsible for the content or information you publish or display (hereinafter "post") on any SelectSmart.com Free and/or Plus Selectors service, or transmit to other members of any SelectSmart.com Free and/or Plus Selectors service. You will not post on any SelectSmart.com Free and/or Plus Selectors any defamatory, inaccurate, abusive, obscene, profane, sexually offensive, threatening, harassing, racially offensive, or illegal materials, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). SelectSmart.com reserves the right to correct any factual inaccuracies, broken links, spelling errors, grammatical errors and/or any other errors. You will not transmit any chain letters or junk E-mail. You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

4. Monitoring. SelectSmart.com RESERVES THE RIGHT, BUT HAS NO OBLIGATION, TO MONITOR THE MATERIALS POSTED IN THE PUBLIC AREAS OF ANY SelectSmart.com Free and/or Plus Selectors service. SelectSmart.com SHALL HAVE THE RIGHT TO REMOVE ANY SUCH MATERIAL THAT VIOLATES, OR IS ALLEGED TO VIOLATE, THE LAW OR THIS AGREEMENT.

5. Intellectual property rights SelectSmart.com shall retain all right, title and interest, including all intellectual property rights, in and to any such software and content provided under this agreement. You acknowledge that the licenses granted pursuant to this Agreement do not provide you with title or ownership of any such software or content provided under this agreement or a copy thereof, but only a right of limited use within the SelectSmart.com website. ALL RIGHTS NOT EXPRESSLY GRANTED ARE RESERVED TO SelectSmart.com.
