If you say you don’t recall, remember or know something and it’s not the truth, you are lying under oath. That's still perjury. Whether Trump is charged with perjury or not, hopefully the jury in the E. Jean Carroll rape/defamation case can see that Trump lies under oath without hesitation.

Trump claimed in a deposition that he couldn’t remember if he was seeing Marla Maples before his divorce. It would be quite a thing to forget.

Trump responded, amazingly, "I don’t know," in the sworn deposition. "It was towards the end of the marriage. So I don’t know, really. It could be a lapover, but I don’t really know."
(It is not clear what a "lapover" means, but we’re guessing it refers to overlap.)
